GENERAL TERMS AND CONDITIONS

This document governs the General Terms and Conditions of Sale ("General Conditions") related to orders, product purchases, and the sharing of information between GrandTour Roma S.r.l., with legal headquarters in Rome, via Dei Coronari n. 32, tax code and registration number in the Rome Business Register 17402791002 ("GRANDTOUR" or "We") and the customer ("You" or "Your") who intends to order and purchase products through the website https://www.grandtourcollection.com ("the Site"). Using the Site to order or purchase products implies your acceptance of these General Conditions and the Privacy Policy, available at privacy@grandtourcollection.com, hereby fully referenced, as well as other notices that may be published on the Site at the time an order is placed, and all applicable laws and regulations. These General Conditions provide information about who we are, how you can purchase products on the Site, how to cancel an order, what to do in case of problems, and other important information. Please carefully review the following General Conditions before placing an order through the Site. If you do not agree with the conditions described in these General Conditions, the Terms of Use, or the Privacy Policy, we invite you not to place orders through the Site.

ORDERS

To place orders on the Site, you must be of legal age and have legal capacity. You may place an order through the Site and pay the price of the chosen product(s) by following the instructions on the Site itself. If it is your first purchase, you can create a personal account by entering your data: name, address, email, and a password. The email address entered during registration will be the one to which the order acceptance will be sent. However, a different delivery address from the one indicated during registration may be specified. If you choose the "Unregistered user payment" option, a personal account will not be created, and GRANDTOUR will use your personal information exclusively for the purpose of processing the order. Once the order form is completed, you can modify the order before submitting it to GRANDTOUR. It is your responsibility to verify the accuracy of the order before submission. In case of problems, you can contact customer service at customerservice@grandtourcollection.com. Once the order is placed (by clicking on the "submit order" button), GRANDTOUR will confirm receipt with the sending of a first automatic email sent to the registration address you indicated ("Receipt Confirmation"). This Receipt Confirmation does not represent acceptance by GRANDTOUR. Each order is subject to explicit acceptance by GRANDTOUR, and GRANDTOUR reserves the right to cancel an order even after sending the Receipt Confirmation (see the "Order Confirmation" Section). You can place an order through the Site and choose the shipping service or pick up with payment at GRANDTOUR stores ("Payment and Pickup in Store"). For orders with Payment and Pickup in Store, you must go to the reference GRANDTOUR store within fourteen (14) days from the receipt of the order confirmation by GRANDTOUR to pay and pick up the product. If you do not go to the store within the indicated period, the order will be considered canceled. When picking up the order, make sure to have with you the confirmation email of the order, to be shown printed or displayed on your mobile device, along with the original of a valid identification document. If the pickup is to be done by a person you have delegated, that person must have with them the original of the delegation you signed, bearing the name, surname, date, and place of birth of the delegated person, the order confirmation email, and the original of their own valid identification document and a document of the customer on whose behalf they are performing the pickup. We will check and record the serial number of their identification document. Before accepting the product, you or the person you have delegated, must sign the delivery receipt of the order. The signed delivery receipt constitutes proof of delivery and acceptance of the ordered products. For this purpose, our records constitute proof of delivery, and it will not be possible to raise disputes regarding this if the order appears delivered.

CONFIRMATION OF ORDERS

To place an order, you must select the products you wish to purchase and click on “Add to cart.” The selected products will then be added to the “cart,” and the order can be concluded by completing the appropriate form and accepting the General Conditions of Sale as indicated on the Site. Before finalizing the order, you must verify the accuracy of the information provided and correct any inaccuracies. The order will be sent by clicking on the “submit order” button. Submitting the order by clicking on the “submit order” button does not imply acceptance of the order and conclusion of the purchase. Your order, in fact, constitutes an offer to buy from GRANDTOUR. Once submitted, the order will be processed by GRANDTOUR. GRANDTOUR will send an email to the address you indicated with a first order confirmation email ("Receipt Confirmation") containing a summary of the Terms of Sale, the product information with payment methods, withdrawal, shipping costs, and applicable taxes. The acceptance of the order by GRANDTOUR will be confirmed by sending a second email ("Order Acceptance") regarding the confirmation of the order dispatch and the delivery of the product(s), with which GRANDTOUR will provide a shipment tracking number and delivery times. You can cancel an order at any time until GRANDTOUR sends the Order Acceptance. Once accepted by GRANDTOUR through the Order Acceptance, the order cannot be modified or canceled, except as otherwise provided by these General Conditions or by law. Furthermore, GRANDTOUR reserves the right to verbally confirm orders. The contract between You and GRANDTOUR is concluded only at the time of sending the Order Acceptance and will concern only the products whose dispatch has been confirmed. GRANDTOUR retains the transactions with its customers. You are invited to download these General Conditions and the Order Acceptance. In case of a dispute relating to an order made on the Site, the data kept by GRANDTOUR will constitute proof of the transaction.

GENERAL RULES

Orders can only be made for personal uses, excluding any commercial purpose. Before acceptance, GRANDTOUR reserves the right to cancel any order when there are valid reasons such as, without limitation, if: (a) You have been involved in a dispute with GRANDTOUR concerning a previous order; (b) GRANDTOUR has reason to suspect that You (i) have violated these General Conditions, (ii) have not made payment for the purchased products by the due date; (iii) are involved in fraudulent or gray market activities (i.e., resale of products through channels not belonging to the authorized sales network of GRANDTOUR or its affiliates); (iv) refuse to provide information that GRANDTOUR is required to collect by law; (c) GRANDTOUR believes that canceling the order is mandatory under the law; (d) GRANDTOUR has the right to cancel an order under these General Conditions. In case GRANDTOUR cancels an order, it will refund any payment previously made. GRANDTOUR makes every effort to ensure that the color, design, and style of the GRANDTOUR products depicted on the Site are as representative as possible of the original products. However, the appearance of the original product may slightly differ from what is depicted on the Site for technical reasons or other motivations. Within the limits allowed by law, GRANDTOUR will therefore not be responsible for any errors or inaccuracies in the photographs or graphic representations of GRANDTOUR products displayed on the Site, except as provided by these General Conditions. No provision of these General Conditions shall exclude or limit rights or remedies that are non-derogable and that you may exercise under the law. AVAILABILITY

The display of a product on the Site does not imply that it is definitely available for online purchase. GRANDTOUR reserves the right to modify, from time to time, the assortment of products available on the Site without prior notice. GRANDTOUR will not be responsible if a product is sold out or no longer available. In the event that, after the Receipt Confirmation of the order, the product you chose is no longer available, the GRANDTOUR customer service or your sales consultant will inform you by phone or email or another agreed means of communication as soon as possible. You will then have the opportunity to choose another product or cancel your order. If the order consists of multiple products, the customer service or your sales consultant will inform you by phone or email to communicate which part of the order is still available and assist you in choosing whether to cancel the entire order or modify it. In any case, you will only be charged for the part of the order that is available and that you wish to purchase anyway. If you choose to replace the item that is no longer available, a new order will be created for the new product you have selected.

PRICES AND PAYMENTS

The prices of GRANDTOUR products are indicated in Euros and include all applicable taxes. Shipping costs are indicated separately under each Product. GRANDTOUR reserves the right to change the prices of the products displayed on the Site at any time and without any prior notice. You will be charged the price displayed on the Site at the moment your order was submitted by clicking on the "submit order" button. You will also be responsible for the costs incurred in using the distance communication means used to send the order (such as telephone rate and internet connection). For each order placed through the Site, you must make the payment at the time the order is placed. Payments are accepted exclusively via ApplePay, PayPal, and credit card issued by the following institutions: Visa, Amex, MasterCard, Maestro, Carta Si. If you wish to receive an invoice for your order, you can contact GRANDTOUR through customer service, sending an email to customerservice@grandtourcollection.com or by phone at +39 0695225885, before concluding the order. Orders placed from the GRANDTOUR Site can also be paid via bank transfer. Always indicate the order reference number in the bank transfer form. After placing the order and selecting bank transfer as the payment method, GRANDTOUR will await receipt of the payment before processing the order. If the amount due is not credited to our bank account within seven (7) business days following the placement of the order, the order will be canceled. If, for any reason, GRANDTOUR is unable to accept an order, it may, at its discretion, not proceed with charging or refund the price already paid concerning the order. GRANDTOUR will not proceed with the shipment of the product(s) until full payment has been received. Prices are subject to change at any time, but such changes will not affect orders already confirmed in the manner described above.

RESERVATION OF OWNERSHIP AND TRANSFER OF RISKS

The product will remain the property of GRANDTOUR until the full amount has been paid. The ordered products will remain under the responsibility of GRANDTOUR until they are signed for and received by you. Once you have received the products, you accept and assume all risks related to the products (including loss, theft, or damage).

DELIVERY

The products will be shipped to the address you entered during the ordering process and indicated in the order confirmation. Only one address can be entered for each order. The products will be shipped in a single package that includes the product, packaging, payment receipt or invoice if requested, and, as applicable, jewelry certification and warranty certificate. A paid gift-wrapping service with a customizable card is available. Receiving the package requires the signature of an adult.

TIMING AND COSTS OF SHIPPING

Except for customized products, orders will be delivered by courier referring to the estimated shipping date indicated on the product description page. Shipping fees apply to orders below a certain amount.

PROBLEMS IN DELIVERY

In case of non-delivery of the Product(s) within 30 days from the forwarding of your order, or within a different term agreed between the parties, you may withdraw from the contract, and GRANDTOUR will refund the price. Any withdrawal must be communicated to GRANDTOUR within 15 days from the expiration of the 30-day term mentioned above. Once you have received the order, you must check the products. If the products received do not conform to the order you placed, or you are not satisfied, you must immediately contact customer service via email at customerservice@grandtourcollection.com, or by phone at +39 0695225885, and request a return or replacement in accordance with the Return Policy.

RETURN POLICY

a) General Rules Except for custom-made or personalized products, under Articles 52 and following of the Italian Consumer Code, you can return a product purchased through the Site, and obtain a refund of the price paid or request a replacement with another product (of a different size or color), by clearly informing us of your intention to do so within 14 calendar days from the date of delivery of the product: by contacting our customer service at the email address customerservice@grandtourcollection.com or at the phone number +39 0695225885 or via the Site. You are required to return the Product(s) within 14 days from the date on which you communicated to GRANDTOUR your decision to exercise the right of withdrawal. All returns must contain the original sales receipt and be returned in the original packaging. The right of withdrawal is excluded for personalized products (such 

such as products with engravings) and olfactory creations, which therefore cannot be returned, refunded, or replaced. All products returned as a result of a return or replacement request are subject to a quality check before being accepted. Products showing signs of wear, damage, or alteration (including sizing changes) or whose label, if present, has been removed will not be accepted. You will be refunded the price of the products whose return has been accepted by GRANDTOUR. However, you will be responsible for any diminished value of the returned products due to handling that goes beyond what is necessary to establish the nature, characteristics, and functioning of the products. The return of the product will be at your expense and responsibility; you are advised to keep a copy of the proof of return via insured mail or another method that provides proof of the delivery date. You must also insure the return of the product against theft and loss for the value of the product. Our Return Policy does not intend to exclude or limit in any way rights or remedies that are non-derogable and available to you under the law.

WARRANTY

The legal warranty guaranteed to consumers applies to products purchased through the Site; this warranty cannot be excluded or altered. If you find that a Product sold through the Site has manufacturing defects or does not match the description, you must immediately contact GRANDTOUR customer service at customerservice@grandtourcollection.com to arrange for the repair or replacement of the Product. GRANDTOUR is legally obliged to respect the warranty for conformity defects of the Products it has sold through the Site as set out in Articles 128 and following of the Italian Consumer Code, in addition to the warranty for hidden defects contained in Articles 1490 and following of the Italian Civil Code. In the event of non-conformity, you have two (2) years from the date of delivery of the Products to act. You may request the repair or replacement of the Product or other remedies in accordance with the conditions provided by Article 135-bis and following of the Italian Consumer Code. In the case of defects not deceitfully concealed by GRANDTOUR, you have twenty-six (26) months from the date of delivery of the Products to act. Damages, alterations, or modifications to the Products caused by you are not considered manufacturing defects or lack of conformity. For example, without limitation: damages caused by prolonged use or wear over time; improper use (such as direct exposure to heat, contact with harmful external agents); normal wear and tear and non-compliance with the instructions for caring for the Products are not considered manufacturing defects or lack of conformity. In the event that you request the repair, replacement, or return of a Product due to manufacturing defects, GRANDTOUR will bear the shipping costs for returning the Products to be repaired, replaced, or refunded, as well as the costs to send you the repaired or replaced Products. GRANDTOUR does not offer additional conventional warranties on the Products.

AUTHENTICITY GUARANTEE

GRANDTOUR guarantees the authenticity of all products purchased through the Site.

APPLICABLE LAW

These General Conditions, their interpretation and execution, including transactions made through the Site, are governed by Italian law, excluding conflict of laws provisions and anyway the rules of private international law. The applicability of the Vienna Convention on the Sale of Goods of 1980 is also excluded. Each party irrevocably commits to submit to the jurisdiction of the Italian courts in relation to any claim or any other matter regarding these General Conditions. The European ODR platform for out-of-court resolution of disputes concerning contractual obligations arising from online sales or service contracts between a consumer residing in the European Union and a professional established in the Union, provided by EU Regulation No. 524/2013, is also available at www.ec.europa.eu/consumers/odr/.

DURATION GRANDTOUR

may amend, suspend, or discontinue the operation of the Site at any time. We reserve the right to limit, suspend, or terminate your access to the Site and/or its services if we have reason to believe that you are violating these General Conditions or applicable laws, or for any other reason, without prior notice or liability on our part. We may prevent the use of the Site in case of repeated violations of intellectual property rights.

WAIVER

The failure of GRANDTOUR to exercise any right or provision of these General Conditions does not constitute a waiver of such right or provision. If any clause of these General Conditions is deemed wholly or partially null or ineffective, such nullity or ineffectiveness will not extend to other clauses of these General Conditions which will remain fully effective.

BINDING AGREEMENT

The acceptance of the order by GRANDTOUR and these General Conditions constitute the entire agreement between You and GRANDTOUR regarding the subject matter hereof.

The contents of the Site are subject to copyright by GRANDTOUR.
